Terms of Service

These Terms of Service ("Terms") govern your access to and use of Athalyze's mobile applications, websites, and related services (collectively, the "Service"). The Service is operated by Perimint LLC ("Athalyze," "we," "us," "our").
By accessing or using the Service, you agree to be bound by these Terms. If you do not agree, do not use the Service.
1. Eligibility
You must be old enough to use the Service under applicable law, including being old enough to consent to the processing of your personal information and to enter into these Terms. If you are not old enough to provide valid consent or to enter into these Terms in your country of residence, you may use the Service only with the involvement and consent of a parent or legal guardian (including, where required by law, verified parental or guardian consent), who agrees to be responsible for your use of the Service.
Athalyze is not directed to children. Where local law requires verified parental or guardian consent for a child to provide personal information, children may provide personal information to Athalyze only with such verified consent and only to features or services that support use by children. If we learn that personal data has been collected from a child without required consent, or from a child below the minimum age permitted by applicable law, we will take steps to delete that information.
The definition of a "child" may vary depending on your country of residence and typically refers to individuals under the age of 13 to under the age of 18.
2. Accounts and Security
You may need an account to use certain features. You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. You agree to notify us promptly of any unauthorized use or security breach.
3. The Service and Fitness/Health Disclaimer
The Service provides tools for logging, viewing, and analyzing fitness and activity data. The Service is for informational and educational purposes only and is not medical advice. Athalyze is not a healthcare provider. Always seek the advice of a qualified professional before beginning or changing a fitness program, especially if you have any medical condition.
You acknowledge that physical activity involves risk of injury or death. You assume all risks associated with your activities and your use of the Service, including reliance on any metrics, analysis, leaderboards, coaching features, or recommendations displayed in the Service.
4. User Content and Data
"User Content" means content you submit to the Service, including profile information, workout files (e.g., FIT/GPX/TCX), workout titles/notes, comments, photos, and any other materials you upload or transmit.
You retain ownership of your User Content. However, you grant Athalyze a non-exclusive, worldwide, royalty-free license to host, store, reproduce, process, modify (for formatting and analysis), display, and distribute your User Content solely to operate, provide, maintain, and improve the Service and as permitted by your settings.
This license includes the right for Athalyze to allow our service providers (acting on our behalf and under appropriate contractual protections) to process User Content for these purposes, and to transfer this license as part of a merger, acquisition, reorganization, or sale of assets.
Athalyze may use aggregated and de-identified information (for example, overall usage trends or totals) for analytics and marketing. Athalyze will not use your identifiable User Content (such as a specific workout, route, or screenshot tied to you) in marketing or promotional materials without your permission.
You represent and warrant that you have all rights necessary to submit User Content and that your User Content does not violate any law or any third-party rights.
5. Connected Services and Imports
The Service may allow you to connect third-party services or import workout files to bring data into Athalyze ("Connected Services"). Your use of Connected Services is subject to the terms and privacy policies of those third parties. Athalyze does not control those services and is not responsible for their availability, accuracy, or actions.
You authorize Athalyze to receive and process data you choose to import or authorize Connected Services to send to Athalyze. You can disconnect Connected Services to stop future imports, but previously imported data may remain unless you delete it.
6. Social Features, Friends, and Coaching
The Service includes social features such as leaderboards, public workouts, friends, and coaching relationships. What others can see depends on the feature and your settings.
- Leaderboards: Leaderboards may display information such as your display name (or username), profile photo (if provided), age group/category (if applicable), and performance results relevant to ranking (e.g., time, distance, pace, power, steps, or other metrics).
- Public workouts: You may choose to mark individual workouts as public. If you make a workout public, other users (and potentially non-users, depending on how the feature is implemented) may be able to view workout information you choose to share, which may include the workout title, date/time, activity type, performance metrics, notes, and route/location data if included in the workout data.
- Friends and shared workouts: You may connect with other users as "Friends." Friends may access limited information you share, such as workouts you share and selected workout details and summaries, depending on your sharing settings.
- Coaches: You may choose to designate another user(s) as your "Coach." Coaches can only be assigned by you. If you assign a Coach, that Coach may have access to all information in your Athalyze account and activity history, including profile information, workouts, performance metrics, and route/location data included in your workout data, to support coaching and analysis. You can remove or change your Coach at any time in your settings, which will revoke future access.
Public content and sharing links: If you choose to make content public, you authorize Athalyze to display that content publicly, including to people who do not have an Athalyze account, and to distribute it as necessary to provide the public feature (for example, via sharing links). Public workout pages may be indexed and stored by search engines, and we cannot guarantee that search engines or other third parties will not copy, cache, archive, or redistribute public content.
You are responsible for selecting who you share information with and for maintaining appropriate privacy settings. Do not assign a Coach unless you intend to grant that person access as described above.
You are responsible for your sharing choices. Information you make public may be copied, saved, or shared by others. Athalyze is not responsible for how others use information you choose to share.
7. Prohibited Activities
You agree not to:
- Violate any applicable law or regulation;
- Impersonate any person or entity or misrepresent your affiliation;
- Post or transmit unlawful, harmful, threatening, abusive, harassing, defamatory, obscene, hateful, or otherwise objectionable content;
- Upload or transmit malware, viruses, or malicious code;
- Attempt to gain unauthorized access to the Service or related systems;
- Interfere with or disrupt the integrity or performance of the Service;
- Scrape, harvest, or collect information from the Service in an automated way without our permission;
- Reverse engineer or attempt to derive source code or underlying ideas of the Service except to the extent permitted by law;
- Use the Service in a way that infringes the rights of others or exposes Athalyze or users to liability.
8. Subscriptions, Fees, and Billing
Some features may require a paid subscription ("Paid Features"). Pricing, billing frequency, and included features will be presented at the time of purchase.
- App Store purchases: If you purchase a subscription through Apple, your purchase is processed by Apple and subject to Apple's terms. Subscription management (including cancellation) is handled through your Apple account settings.
- Website purchases: If you purchase through our website, payments may be processed by Stripe or another payment provider. Subscription management and cancellation will be available through your Athalyze account settings or by contacting support, depending on how the purchase was made.
Renewals and cancellation: Subscriptions generally renew automatically unless canceled before the renewal date. Cancellation stops future renewals; access typically continues until the end of the current billing period.
Refunds: Refund requests are handled according to the platform or payment provider's policies (for example, Apple's refund policies for App Store purchases).
9. Intellectual Property
The Service and all related content and materials (excluding User Content) are owned by Athalyze and its licensors and are protected by intellectual property laws. You may not use our trademarks, logos, or branding without our prior written consent.
10. Third-Party Links and Services
The Service may contain links to third-party websites or services. We do not control and are not responsible for third-party content, products, or services. Your dealings with third parties are solely between you and the third party.
11. Termination
We may suspend or terminate your access to the Service at any time if we reasonably believe you have violated these Terms or if necessary to protect the Service, users, or third parties. You may stop using the Service at any time.
Upon termination, your right to use the Service will cease. Sections that by their nature should survive termination (including licenses, disclaimers, limitation of liability, and governing law) will survive.
12. Disclaimer of Warranties
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, AND ANY WARRANTIES ARISING OUT OF COURSE OF DEALING OR USAGE OF TRADE.
ATHALYZE DOES NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, SECURE, OR ERROR-FREE, OR THAT ANY DATA OR ANALYSIS WILL BE ACCURATE OR RELIABLE.
13. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, ATHALYZE AND ITS AFFILIATES, OFFICERS, EMPLOYEES, AGENTS, AND LICENSORS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, ARISING OUT OF OR RELATED TO YOUR USE OF (OR INABILITY TO USE) THE SERVICE.
TO THE MAXIMUM EXTENT PERMITTED BY LAW, ATHALYZE'S TOTAL LIABILITY FOR ALL CLAIMS ARISING OUT OF OR RELATING TO THE SERVICE WILL NOT EXCEED THE AMOUNT YOU PAID (IF ANY) FOR PAID FEATURES IN THE 12 MONTHS PRIOR TO THE EVENT GIVING RISE TO THE CLAIM, OR $100 IF YOU HAVE NOT PAID ANY AMOUNTS.
14. Indemnification
You agree to indemnify and hold harmless Athalyze and its affiliates, officers, employees, agents, and licensors from and against any claims, liabilities, damages, losses, and expenses (including reasonable attorneys' fees) arising out of or in any way connected with your access to or use of the Service, your User Content, or your violation of these Terms or applicable law.
15. Changes to the Terms
We may update these Terms from time to time. We will post the updated Terms and update the "Last updated" date above. If changes are material, we may provide additional notice (such as via the Service or email). Your continued use of the Service after changes become effective constitutes acceptance of the updated Terms.
16. Governing Law
These Terms are governed by the laws of the State of Indiana, without regard to conflict of law principles.
